Terms of Service

1. Introduction and acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you and Hari Cornucopia Tech Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 12-58/B, Jaggayyapalem, Jaggayyapalem, Visakhapatnam, Pedagantyada, Andhra Pradesh, India — 530012 (CIN: U62012AP2023PTC111685) ("HCTPL", "we", "us", or "our").

HCTPL Global Staffing ("Platform") is a software product of HCTPL that provides AI-assisted staffing workflows, client workspaces, recruitment automation, interview tooling, and related services.

By accessing or using the Platform, creating an account, scheduling a discovery call, signing a staffing agreement, or making a payment, you agree to these Terms. If you do not agree, you must not use the Platform.

2. Eligibility and authority

The Platform is intended for businesses, hiring organisations, recruitment professionals, and candidates participating in legitimate hiring programmes.

If you register on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

• You must be at least 18 years of age.
• You must provide accurate registration information and keep it current.
• You must not use the Platform for unlawful, fraudulent, or deceptive purposes.

3. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

We may suspend or terminate accounts that violate these Terms, pose security risks, or remain unpaid where payment is required for access.

• Notify us promptly at haricornucopiatech@gmail.com if you suspect unauthorised access.
• Do not share passwords or allow unauthorised users to access paid client workspaces.
• We may require identity or business verification before activating certain features.

4. Nature of services

The Platform facilitates recruitment operations including lead discovery, mandate intake, job description workflows, candidate sourcing and screening, interview scheduling, tiered assessment programmes, shortlist delivery, and client portal visibility.

AI features—including conversational agents such as sales and recruiter bots—provide assistance based on configured rules, models, and data you supply. Outputs are decision-support tools and do not replace your independent hiring judgment, compliance obligations, or employment decisions.

Service tiers (Basic, Professional, Enterprise) define the depth of interview and assessment capabilities available for a mandate. Tier descriptions on the marketing site and in commercial agreements control in case of conflict with informal communications.

5. Commercial terms and staffing agreements

Subscription fees, placement fees, payment terms, and mandate-specific commercial conditions are set out at signup, in order confirmations, in the Client Workspace, and/or in executed staffing or mandate agreements.

Where a signed or portal-approved mandate agreement exists, its commercial terms prevail over general marketing descriptions for that mandate.

Fees are quoted in Indian Rupees (INR) unless otherwise stated. Taxes, including GST where applicable, may apply in addition to stated prices.

6. Acceptable use

You agree not to misuse the Platform. Prohibited conduct includes scraping, reverse engineering, interfering with security, uploading malware, harassing users, discriminating unlawfully in hiring, misrepresenting candidate or client data, or attempting to bypass tier or payment controls.

7. Intellectual property

HCTPL and its licensors own the Platform, software, branding, documentation, and underlying technology.

You retain ownership of content you upload (job descriptions, candidate data subject to applicable law, organisation names, etc.). You grant us a limited licence to host, process, and display that content solely to provide the services.

8. Confidentiality

Each party may receive confidential information through the Platform or related engagements. You agree to protect confidential information using reasonable care and to use it only for permitted recruitment purposes, except where disclosure is required by law.

9. Disclaimers

The Platform is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted availability, error-free AI outputs, or that any candidate will accept an offer or meet your requirements.

We are not the employer of candidates presented through recruitment programmes unless expressly agreed in writing for a specific engagement model.

10. Limitation of liability

To the maximum extent permitted by applicable law, Hari Cornucopia Tech Private Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity.

Our aggregate liability arising from the Platform or these Terms shall not exceed the greater of (a) fees paid by you to us for the Platform in the three months preceding the claim, or (b) INR 50,000, except where liability cannot be limited under applicable law.

11. Indemnity

You agree to indemnify and hold harmless Hari Cornucopia Tech Private Limited, its directors, officers, and personnel from claims arising from your misuse of the Platform, violation of law, infringement of third-party rights, or inaccurate data you provide.

12. Suspension and termination

We may suspend or terminate access for breach, non-payment, security concerns, or legal requirements. You may stop using the Platform at any time; certain provisions survive termination, including payment obligations, confidentiality, intellectual property, disclaimers, and liability limits.

13. Governing law and disputes

These Terms are governed by the laws of India. Courts at Visakhapatnam, Andhra Pradesh shall have exclusive jurisdiction, subject to any mandatory consumer protection or arbitration requirements that cannot be contracted away.

Before formal proceedings, parties agree to attempt good-faith resolution by contacting haricornucopiatech@gmail.com.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on the Platform with an updated date. Continued use after changes constitutes acceptance.
